We=E2=80=99re writing to let you know that Mailchimp is updating our Stand=
ard Terms of Use (TOU) later today=2C May 15=2C 2019. Before the updated T=
OU are live on our website=2C you can preview them here (https://mailchimp=
=2Eus17.list-manage.com/track/click?u=3D7408690b9f7fe1132e6e7422b&id=3D82ffa=
80831&e=3D994c25c522) . These changes will affect two primary areas:=
 our pricing and our data processing addendum. You can read more about the=
se changes below.

** Pricing
------------------------------------------------------------
As of today=2C Mailchimp is moving to a new pricing model for new paid use=
rs as well as current paid users who choose to switch to one of our new pa=
id plan offerings. We=E2=80=99re updating Section 7 of our TOU to reflect=
 these changes.
* Section 7A =E2=80=93 self-tiered pricing
This section will describe how users can choose their preferred package=2C=
 based on the feature set that works best for them. Then=2C they=E2=80=99l=
l choose their projected audience to create their full pricing plan. Under=
 this new pricing model=2C a user=E2=80=99s account will no longer auto-ad=
just to a higher or lower paid tier based on use.
* Section 7B =E2=80=93 audience
This section will describe our new method of defining an audience of conta=
cts based on a user=E2=80=99s ability to market to or interact with those=
 contacts=2C as well as a new archiving feature that allows users to move=
 contacts out of their audience.

We=E2=80=99re also updating Sections 8 and 9 of our TOU=2C which will appl=
y to our free plans and Pay as You Go credits=2C respectively.

** How these changes will affect you
------------------------------------------------------------
* If you are a current monthly paid user
You can keep your current monthly plan and pricing.
* If you are a current Pay as You Go user
All credits purchased before May 15=2C 2019 will expire on May 15=2C 2020=
=2C and all credits purchased on or after May 15=2C 2019 will expire 12 mo=
nths after purchase.
* If you are a current free user
You can remain a free user so long as you have 2=2C000 or fewer contacts i=
n your audience=2C and you=E2=80=99ll now have the new free plan features.=
 If the new way of counting contacts causes your audience to exceed 2=2C00=
0 contacts before June 15=2C 2019=2C we=E2=80=99ll automatically archive y=
our unsubscribed and transactional contacts. After June 15=2C we=E2=80=99l=
l begin calculating your audience as described in Section 7B of our TOU=2C=
 but you can always manually archive contacts to keep your audience under=
 2=2C000 contacts.

** Data Processing Addendum (DPA)
------------------------------------------------------------
We=E2=80=99re also making changes to our DPA=2C which explains our contrac=
tual obligations as a data processor under the GDPR when we process person=
al data about you and your contacts in connection with our services. Previ=
ously=2C Mailchimp users subject to the GDPR had to sign and submit an agr=
eement. Now=2C we=E2=80=99ll make it easier to comply with the GDPR by aut=
omatically incorporating the DPA into our TOU; it=E2=80=99s available to r=
ead on our website (https://mailchimp.us17.list-manage.com/track/click?u=
=3D7408690b9f7fe1132e6e7422b&id=3D5931cd719a&e=3D994c25c522) .

** Who this affects
------------------------------------------------------------
If you=E2=80=99re located in a member state of the European Economic Area=
=2C the United Kingdom=2C or Switzerland=2C or if you distribute content t=
hrough Mailchimp to (or collect information through Mailchimp from) anyone=
 located in those countries=2C you=E2=80=99re now automatically a party to=
 our DPA=2C so please be sure to review it at your earliest convenience. I=
f you currently have a DPA on file with Mailchimp=2C you previously receiv=
ed an email (subject line: =E2=80=9CUpdates to Mailchimp=E2=80=99s DPA=E2=
=80=9D) with more information.

By continuing to use Mailchimp after the updated Standard Terms of Use are=
 released=2C you agree to accept the updated Standard Terms of Use. If you=
 don't agree to the updated Standard Terms of Use=2C you can terminate you=
r account as described in Section 3.
